COMMISSIONER'S NOTICE OF SALE
WHEREAS, on July 25, 2022, Jimmy Andrews and Christina Andrews executed a Deed of Trust to Michael A. King, Trustee for the benefit of Trustmark National Bank, as recorded in the office of the Chancery Clerk of Newton County, Mississippi, in Book 474 at Page 732; and, WHEREAS, on January 17, 2025, the Chancery Court of Newton County in Civil Action No. 24-cv-22 executed and entered a Judgment Authorizing Judicial Foreclosure Subject to Confirmation (“Judicial Foreclosure Judgment”) which was also recorded in Book 411 at Page 212 in the office of the aforesaid Chancery Clerk; and, WHEREAS, the Judicial Foreclosure Judgment ordered that Marc K. McKay be appointed Commissioner for the purpose of conducting a foreclosure sale of the property described in the subject Deed of Trust; and, WHEREAS, the Judicial Foreclosure Judgment ordered that the Commissioner, Marc K. McKay, is authorized to execute the trust and sell the land and property described therein in accordance with the terms of the Deed of Trust for the purpose of raising the sums due thereunder, together with attorney fees, Commissioner's fees and expenses of sale; and, WHEREAS, the Judicial Foreclosure Judgment ordered that, on Trustmark's request following sale, a date for a confirmation hearing will be set; and, WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust and the legal holder of said indebtedness having requested the undersigned Commissioner to execute the Trust and sell said land and property in accordance with the terms of said Deed of Trust, as reformed, and in accordance with the Judicial Foreclosure Judgment for the purpose of raising the sums due thereunder, together with attorney fees, Commissioner's fees and expenses of sale;
NOW, THEREFORE, I, the undersigned Marc K. McKay, being the Commissioner, do hereby give notice that on September 3, 2025, between 11:00 o'clock a.m. and 4:00 o'clock p.m., being the legal hours of sale, I will proceed to sell at public outcry, to the highest bidder for cash, at the front door of the Newton County Courthouse in Decatur, State of Mississippi, the following real property described and conveyed in said Deed of Trust, as reformed, lying and being situated in Newton County, Mississippi, and being more particularly described as follows, to-wit: The following described property located in Newton County, Mississippi, to-wit:
Three (3) acres in the SW corner of the SW ¼ of the SE ¼ of Section 36, T7N, R12E, Newton County, Mississippi, described as beginning at the SW corner of the SW ¼ of the SE ¼ and run thence East along the North side of public road 420 feet; thence North 315; thence West 420 feet; thence South 315 feet to the point of beginning. Said property being the SW ¼ of the SE ¼ of Section 36, T7N, R12E, Newton County, Mississippi. I will convey only such title as is vested in me as Commissioner.
