NOTICE OF SALE
WHEREAS, on October 24, 2017, Heather McDaniel executed a Deed of Trust to Bobby Knox, Trustee for Community Bank, Ellisville, Mississippi, which Deed of Trust was recorded on October 26, 2017, at Book 422, Page 567 in the office of the Chancery Clerk of Newton County, Mississippi, pertaining to the following described property situated in said County and State, to-wit:
WHEREAS, the aforesaid Community Bank, Ellisville, Mississippi, the holder of said deed of trust and the note secured thereby, substituted Paul D. Walley, as Trustee therein, as authorized by the terms thereof, by instrument dated July 13, 2022 and recorded July 26, 2022 at Book 474, Page 175 in the office of the aforesaid Chancery Clerk of Newton County, Mississippi; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said deed of trust, and the legal holder of said indebtedness, Community Bank, Ellisville, Mississippi, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substituted Trustee's fees and expense of sale;
NOW, THEREFORE, I, Paul D. Walley, Substituted Trustee in said deed of trust, will on September 29, 2022 offer for sale at public outcry for cash to the highest bidder, and sell within legal hours (being between the hours of 11:00 A.M. and 4:00 P.M.) on the steps of the Newton County Courthouse located in Decatur, Mississippi, the following described property situated in the County of Newton, State of Mississippi, to-wit:
Commence at the Southeast Corner of the SE ¼ of the SE ¼ of Section 13, Township 7 North, Range 11 East, Newton County, Mississippi; thence run West a distance of 3,033.76 feet to a point; thence run North a distance of 974.23 feet to a ½ inch round iron pin on the East right-of-way of Sims Road; said iron pin also being the Point of Beginning for the herein described parcel of land; thence run North 04 degrees 55 minutes 42 seconds West along the East right-of-way of Sims Road a distance of 211.96 feet to a ½ inch round iron pin; thence leaving said right-of-way run East a distance of 209.40 feet to a point; thence run South 04 degrees 56 minutes 05 seconds East a distance of 206.06 feet to a point; thence run South 88 degrees, 23 minutes, 15 seconds, West a distance of 209.0 feet back to the Point of Beginning; said parcel of land is a part of the SE ¼ of the SW ¼ of Section 13, Township 7 North, Range 11 East, Newton County, Mississippi, and contains 1.00 acre, more or less.
