SUBSTITUTED TRUSTEE'S
NOTICE OF SALE
WHEREAS, on December 10, 2013, Richard Parker Blackburn, Subject to the Life Estate of Ola Jean Parker, and Ola Jean Parker, Life Estate executed a Deed of Trust to Thomas R. Hudson, Trustee for the use and benefit of BankPlus, which Deed of Trust is recorded in Trust Book 379 at Page 478 et seq, in the office of the Chancery Clerk of Newton County, Mississippi, subject to Modification of Deed of Trust dated January 19, 2017 and executed on January 27, 2017 and recorded in Trust Book 414 at Page 398; and
WHEREAS, said Deed of Trust authorized the appointment and substitution of another Trustee in the place of the Trustee named in said Deed of Trust and BankPlus pursuant to said Deed of Trust, substituted John G. Compton as Trustee in the place of Thomas R. Hudson by written instrument dated August 23, 2022 and duly recorded in Book 475 at Page 166 thereof in the office of the Chancery Clerk of Newton County, Mississippi; and
WHEREAS, default having been made in the performance of the conditions and stipulations as set out in the Deed of Trust and the said Substitute Trustee having been requested and directed by said BankPlus, to execute the trust; and in strict accordance with the Deed of Trust aforesaid and the laws of the State of Mississippi, the dates for publication of this Notice of Substituted Trustee's Sale in The Newton County Appeal, a newspaper published in the City of Union, Newton County, Mississippi, having been set at the following, to-wit: the 7th day of September, 2022; the 14th day of September, 2022; the 21st day of September, 2022; and the 28th day of September, 2022. I will on the 5th day of October, 2022, during the legal hours, at the main door of the Newton County Courthouse in Decatur, Mississippi, offer for sale, at public auction and sell to the highest and best bidder for cash, the following described property situated in the County of Newton, State of Mississippi, and more particularly described as follows, to-wit:
Commencing at a found 3.5 inch x 3.5 inch concrete monument situated near and representing the Northwest corner of the Southwest 1/4 of the Southwest 1/4 of Section 19, Township 6 North, Range 11 East, Newton County, Mississippi; thence run South 50 degrees 44 minutes 15 seconds East a distance of 636.26 feet to a point set on the Eastern right of way line of the Newton-Conehatta Road, said point being a 1/2 inch x 19 inch rebar and also the Point of Beginning of the herein described parcel of land; thence North 89 degrees 38 minutes 37 seconds East a distance of 306.84 feet to a point being a set 1/2 inch x 19 inch rebar; thence South 00 degrees 34 minutes 45 seconds East a distance of 195.71 feet to a point being a set 1/2 inch x 19 inch rebar; thence South 89 degrees 38 minutes 37 seconds West a distance of 231.60 feet to a point set on said Eastern right of way line of said Newton-Conehatta Road, said point being at 1/2 inch x 19 inch rebar; thence coincident with said Eastern right of way line run an arc distance of 209.96 feet along a non-tangential curve concaving East having a radius of 6713.27 feet, the chord of said curve bears North 21 degrees 34 minutes 45 seconds West a distance of 209.95 feet to the point of beginning. The herein described parcel of land contains 1.21 acres, more or less, being situated in and a part of the Southwest 1/4 of the Southwest 1/4 of Section 19, Township 6 North, Range 11 East, Newton County, Mississippi. The above described property is Parcel 1 of an unrecorded plat prepared by Paul Walker on March 7, 2008.
NOTE: The bearings used in this description are grid values in the Mississippi East zone having a convergence angle of negative (-)00 degree 12 minutes 15 seconds calculated at the commencing point.
Title to said property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee.
