AN ORDINANCE AMENDING
ORDINANCE NO. 283
PROHIBITING CERTAIN
VEHICLES FROM TRAVEL ON PORTIONS OF CERTAIN STREETS IN
THE CITY OF UNION, MISSISSIPPI
WHEREAS, the City of Union is charged with the responsibility of repair and
maintenance of the streets in the City of Union, Neshoba and Newton Counties; and
WHEREAS, there exists certain trucks and tractor-trailer vehicles bearing loads of such weight as to cause increased expense for the City of Union in repairs and maintenance for said streets; and
WHEREAS, the City of Union finds that a need exists to prohibit the above mentioned
trucks and tractor-trailer vehicles from the following streets within the corporate limits of the City of Union, Neshoba and Newton Counties, Mississippi:
North Street.
West end of Highway 494 from Highway 15 Bypass Intersection to Intersection of Old Decatur Road.
Old Highway 15 from Intersection of Highway 494 to Highway 15 Bypass.
North end of Old Decatur Road to North Drive of former Apache Products Company; and
WHEREAS, a readily accessible alternate route exists for such trucks and tractor-trailer vehicles to travel within the City of Union, Mississippi; and
WHEREAS, this ordinance is intended to amend the fines and penalties section imposed by Ordinance No. 283 passed by the Mayor and Board of Alderman of City of Union, Mississippi, on or about January 2, 2002, and to supersede the same.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF
ALDERMAN OF THE CITY OF UNION, MISSISSIPPI, AS FOLLOWS, TO-WIT:
SECTION 1: That no truck or tractor-trailer vehicle that bears a gross vehicle weight rating in excess of 7,000 pounds shall be permitted to operate on or utilize the above mentioned streets located within the corporate limits of the City of Union, Neshoba and Newton Counties, Mississippi.
SECTION 2: That any person, firm or other entity, who violates this ordinance shall be subject to a fine in an amount not to exceed $500.00 including assessments and/or ten (10) days in jail for each such violation.
SECTION 3: That this ordinance shall take effect and be in force as provided by the laws of the State of Mississippi.
The foregoing ordinance having been considered section by section, and then as a whole, it was put to a vote and the vote of the Aldermen was as follows:
• Alderman Blount voted Aye
• Alderman Hickmon voted Aye
• Alderman Lowery voted Aye
• Alderman McCune voted Aye
• Alderman Sistrunk voted Aye
It being determined that the ordinance received the affirmative vote of all present, it was declared passed and adopted, this the 5th day of October, 2021.
SO ORDAINED, ENACTED, AND PASSED, by the Mayor and Board of Aldermen of the City of Union, Mississippi, on this the 5th day of October, 2021.
