SUBSTITUTE TRUSTEE'S
NOTICE OF SALE
WHEREAS, on April 3, 2013, JARED ALAN CAVENAUGH and ERICA LORENA RUSHING executed a Deed of Trust to JOHN R. GUNN, Trustee for FIRST STATE BANK, which is recorded in Deed of Trust Book 369 at Page 592 in the land records in the office of the Chancery Clerk of Newton County, Mississippi; and
WHEREAS, FRED ANTHONY MONSOUR, was appointed Substitute Trustee in the place and stead of JOHN R. GUNN, in said Deed of Trust by instrument dated April 24, 2023, and recorded on May 5, 2023 in Deed of Trust Book 481 at Page 131; and
WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness having requested the undersigned Substitute Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expenses of sale.
NOW THEREFORE, I, FRED ANTHONY MONSOUR, Substitute Trustee in said Deed of Trust, will on MAY 31, 2023, offer for sale at public outcry, and sell within legal hours, (being between the hours of 11:00 A. M. and 4:00 P. M.) at the front entrance of the County Courthouse of the County of Newton, State of Mississippi, to the highest and best bidder for cash, the following described property lying and being situated in the County of Newton, State of Mississippi, to-wit:
Commence at an iron pin marking the NE corner of the NE 1/4 of NW 1/4 of Section 20, Township 7 North, Range 13 East, Newton County, Mississippi; thence run West a distance of 529.92 feet to a point; thence run South a distance of 965.42 feet to a 1/2 inch round pin; said point being the point of beginning of the herein described parcel of land; thence run South 29 degrees 39 minutes 21 seconds West a distance of 92.57 feet to a 1/2 inch round iron pin at a fence; thence run North 78 degrees 50 minutes 30 seconds West along said fence a distance of 156.65 feet to a 1/2 inch round iron pin; thence run South 35 degrees 37 minutes 16 seconds West a distance of 69.20 feet to a 1/2 inch round iron pin on the East right of way line of Garrison Road; thence run North 45 degrees 33 minutes 16 seconds West along said East right of way line a distance of 128.71 feet to a point; thence run North 42 degrees 15 minutes 14 seconds West along said East right of way line a distance of 9.56 feet to the South side of a gravel driveway; thence run North 45 degrees 08 minutes 02 seconds East along said South side of a gravel driveway a distance of 69.16 feet to a point; thence run North 61 degrees 04 minutes 57 seconds East along said South side of a gravel driveway a distance of 49.10 feet to a point; thence run North 70 degrees 29 minutes 27 seconds East along said South side of gravel driveway a distance of 51.71 feet to a point; thence run South 84 degrees 03 minutes 56 seconds East along said South side of gravel driveway a distance of 46.50 feet to a point; thence run South 66 degrees 43 minutes 12 seconds East along said South side of gravel driveway a distance of 62.35 feet to a point; thence run South 61 degrees 23 minutes 58 seconds East along said South side of gravel driveway a distance of 106.90 feet back to the point of beginning; said parcel of land is part of the NE 1/4 of NW 1/4 of Section 20, Township 7 North, Range 13 East, Newton County, Mississippi and contains 0.85 acres, more or less.
I will convey only such title as is vested in me as Substitute Trustee.
