TRUSTEE’S NOTICE OF SALE
WHEREAS, on June 24, 2008, New Testament Baptist Church, as further explained below, executed a deed of trust to J. Patrick Caldwell, as Trustee for the benefit of BancorpSouth Bank, which deed of trust is recorded in Book 320, beginning at page 686, in the records in the office of the Chancery Clerk of Newton County, Mississippi, the lien of which deed of trust was extended by a Beneficiary’s Notice of Extension of Lien Created by Deed of Trust which is recorded in Book 439 at page 298 in said records; and
WHEREAS, on January 29, 2020, David Haadsma, an attorney licensed to practice law in the state of Mississippi, executed an Affidavit of Scrivener’s Errors, which Affidavit of Scrivener’s Errors corrected a typographical error in the name of the grantor of the aforesaid deed of trust to New Testament Baptist Church and which Affidavit of Scrivener’s Errors is recorded in Book 445, beginning at page 511, in the records in the office of the Chancery Clerk of Newton County, Mississippi; and
WHEREAS, default having been made under the terms and conditions of said deed of trust, and the holder of said deed of trust and the indebtedness secured thereby, the aforesaid BancorpSouth Bank, having requested the undersigned Trustee to execute the trust and to sell the land and property described in said deed of trust, in accordance with the terms thereof for the purpose of raising the sums due thereunder, together with attorney’s fees, Trustee’s fees and expenses of sale;
NOW, THEREFORE, I, J. Patrick Caldwell, as Trustee under the said deed of trust, will on the 19th day of November, 2020, offer for sale at public outcry for cash to the highest and best bidder, and sell within legal hours (being between the hours of 11:00 A.M. and 4:00 P.M.), at the North front door of the Newton County Courthouse, at Decatur, Mississippi, the following described property and land lying and being situated in Newton County, Mississippi, being more particularly described as follows, to-wit:
Start at the Northwest corner of the NE 1/4 of Section 33, Township 6 North, Range 11 East, Newton County, Mississippi, and run South 47 degrees 07 minutes East, 306.4 feet to a point of intersection with the South right-of-way line of Mississippi Highway No. 15 and U.S. Highway No. 80, Business Route; thence along said right-of-way line South 69 degrees 52 minutes East 298.4 feet to the point of beginning: Thence South 25 degrees 34 minutes West, 200.5 feet; thence South 69 degrees 52 minutes East, 151 feet; thence North 20 degrees 08 minutes East, 200 feet to the South right-of-way line of said highway; thence North 69 degrees 52 minutes West, along right-of-way line of said highway, 133.8 feet to the point of beginning. The above described property being situated in the NW 1/4 of the NE 1/4, Section 33, Township 6 North, Range 11 East, City of Newton, Newton County, Mississippi, and containing 0.65 acres.
I WILL CONVEY only such title as is vested in me as Trustee, without warranty of title.
