SUBSTITUTED TRUSTEE’S NOTICE OF SALE
STATE OF MISSISSIPPI
COUNTY OF Newton
WHEREAS, on the 16th day of June, 2004, Robert E Williams & Pamela Williams, Husband & Wife aka Pamela M Williams, executed and delivered a certain Deed of Trust unto W Stewart Robison, Trustee for Jim Walter Homes, Inc., Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Newton County, Mississippi in Trust Book 276 at Page 436; and
WHEREAS, by various assignments on record said Deed of Trust was ultimately assigned to U.S. Bank, N.A., as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee, for Mid-State Capital Corporation 2005-1 Trust by instrument recorded in the office of the aforesaid Chancery Clerk in Trust Book 451 at Page 730; and
WHEREAS, on the 7th day of October, 2020 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Trust Book 452 at Page 597; and
WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 2nd day of December, 2020, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the North front door of the Newton County Courthouse at Decatur, Mississippi, for cash to the highest bidder, the following described land and property situated in Newton County, Mississippi, to-wit:
Commence at the NE corner of the NE 1/4 of the SE 1/4 of Section 36, T6N, R12E, Town of Hickory, Newton County, Mississippi; thence, run West 445.3 feet; thence run South 303 feet; thence run South 0 degrees 35' East, 39.5 feet to the point of beginning: From said point of beginning continue South 0 degrees 35' East, 104.5 feet; thence run North 89 degrees 05' West, 104.5 feet; thence run North 0 degrees 35' West, 104.5 feet; thence run South 89 degrees 05' East, 104.5 feet to the point of beginning, containing 0.25 acre, more or less, and all being located in the NE 1/4 of the SE 1/4 of Section 36, T6N, R12E, Town of Hickory, Newton County, Mississippi. The above described property is the same property sold to Belzie Houston, Sr., by Monteele Mashburg on May 4, 1988 in Deed Book 211 at page 252 and is the same property conveyed to Monteele Mashburg in a conveyance by the Chancery Clerk of in Deed Book 199 at page 516. This is also part of the same property as shown in property Map Book 106, Parcel 30. I will only convey such title as is vested in me as Substitute Trustee.
