NOTICE OF SALE
WHEREAS, on April 9, 2003, Gerald G Addy, Husband and Sharon I Addy, Wife executed a deed of trust for the benefit of Jim Walter Homes, Inc., which deed of trust was recorded on May 19, 2003, in Book 261, Page 488 in and re-recorded in Book 268, Page 206 in the office of the Chancery Clerk of Newton County, Mississippi; and Said Deed of Trust was last sold, assigned and transferred to The Bank of New York Mellon, as Indenture Trustee, for Mid-State Capital Corporation 2004-1 Trust by assignment recorded in Book 454, Page 250 in the office of the Chancery Clerk, Newton County, Mississippi. WHEREAS, the holder of the deed of trust at the time of the substitution substituted McCalla Raymer Leibert Pierce, LLC as Trustee, as authorized by the terms thereof, by instrument recorded on January 6, 2021, and spread at large upon the records in the office of the aforesaid Chancery Clerk in Book 455, Page 369, prior to the posting and publication of this notice; and WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, The Bank of New York Mellon, as Indenture Trustee, for Mid-State Capital Corporation 2004-1 Trust, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee’s fees and expenses of sale; THEREFORE, on March 3, 2021, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the front door of the Newton County Courthouse in Decatur, Mississippi, the following described land, property and improvements lying and being situate in Newton County, Mississippi, to-wit: Commence at the NE corner of the NW ’ of the NW ’ of Section 1, T6N, R10E, Newton County, Miss, and run thence N87 degrees 57’27’W, 540.91 ft along a fence line to the POB; thence run South 36 degrees 58’17’W, 241.76 ft; thence S19 degrees 01’40’W, 82.72 ft; thence S12 degrees 31’54’E, 137.31 ft; thence West 36.94 ft to the east line of Pleasant Valley Road; thence N10 degrees 15’15’W, 409.18 ft along a line 20 ft perpendicular to and parallel with the centerline of Pleasant Valley Road said line being the east line of said Pleasant Valley Road; thence N89 degrees 22’31’E, 252.37 ft along a fence line to the POB. The herein described property contains 1 acres, more or less and is situated in the NW ’ of the NW ’ of Section 1, T6N, R10E, Newton County, Miss.
