SUBSTITUTED TRUSTEE'S
NOTICE OF SALE
WHEREAS, on August 27, 2003, Bobby Eaton and Deborah Eaton, husband and wife executed a certain deed of trust to Barbara Zirilli, Trustee for the benefit of GMAC Mortgage Corporation which deed of trust is of record in the office of the Chancery Clerk of Newton County, State of Mississippi in Book 266 at Page 7; and
WHEREAS, Ocwen Loan Servicing, LLC has heretofore substituted Shapiro & Brown, LLC as Trustee by instrument dated December 31, 2018 and recorded in the aforesaid Chancery Clerk's Office in Book 434 at Page 652; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, Ocwen Loan Servicing, LLC, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, Shapiro & Brown, LLC, Substituted Trustee in said deed of trust, will on March 9, 2021 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the North Door of the County Courthouse of Newton County, located at 92 West Broad Street, Decatur, MS 39327, to the highest and best bidder for cash or certified funds the following described property situated in Newton County, State of Mississippi, to-wit:
Commence at the Northeast corner of the SE 1/4 of the SW 1/4 of Section 30, T6N, R11E, Newton County, Mississippi, and run thence South, 1235.21 feet; run thence West, 67.86 feet to the point of beginning: Thence South 89° 29' 44" West, 209.07 feet; thence run South 21° 11' 13" East, 387.04 feet to the North line of Lancaster Road; thence run North 58° 10' 45" East, 361.71 feet parallel with and 25 feet perpendicular to the centerline of Lancaster Road along said North line to its intersection with the centerline of an existing gravel drive; thence run Northwesterly along the centerline of said gravel drive as follows: North 35° 34' 51" West, 18.64 feet, North 71 ° 38' 18" West, 33.55 feet, North 87° 18' 38" West, 123.20 feet, North 80° 03' 30" West, 28.82 feet; thence run North 18° 00' 00" West, 142.49 feet to the point of beginning. The herein described property contain 1.75 acres, more or less, and is situated in the SE 1/4 of the SW 1/4 of the said Section 30, and in the NE 1/4 of the NW 1/4 of Section 31, T6N, R11E, Newton County, Mississippi.
I WILL CONVEY only such title as vested in me as Substituted Trustee.
