NOTICE OF SUBSTITUTE TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated November 9, 1995, executed by GLENDA S. JOHNSON conveying certain real property therein described to ROBERT L. SMITH, as Trustee, for UNITED STATES OF AMERICA, ACTING THROUGH THE FARMERS HOME ADMINISTRATION, UNITED STATES DEPARTMENT OF AGRICULTURE, Original Beneficiary, to secure the indebtedness therein described, as same appears of record in the office of the Chancery Clerk of Newton County, Mississippi filed and recorded November 9, 1995, in Deed Book 190, Page 266; and
WHEREAS, the beneficial interest of said Deed of Trust was transferred and assigned to UNITED STATES OF AMERICA, ACTING THROUGH THE FARMERS HOME ADMINISTRATION, UNITED STATES DEPARTMENT OF AGRICULTURE; and
WHEREAS, Rubin Lublin, LLC has been appointed as Substitute Trustee; and
NOW, THEREFORE, the holder of said Deed of Trust, having requested the undersigned so to do, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee shall, on July 24, 2024 within the lawful hours of sale between 11:00AM and 4:00PM at the front door of the Courthouse proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Newton County, Mississippi, to wit:
COMMENCE AT THE NORTHEAST CORNER, SECTION 3, TOWNSHIP 7 NORTH, RANGE 11 EAST, NEWTON COUNTY, MISSISSIPPI, THENCE SOUTH 2616.72 FEET; THENCE WEST 1320.0 FEET; THENCE SOUTH 38 DEGREES 03 MINUTES 53 SECONDS WEST, 898.31 FEET TO THE CENTERLINE OF A GRAVEL PUBLIC ROAD; THENCE SOUTH 61 DEGREES 47 MINUTES 50 SECONDS EAST, 81.2 FEET TO A POINT IN SAID CENTERLINE; THENCE NORTH 53 DEGREES 48 MINUTES 37 SECONDS EAST, 33.18 (APPEARING AS 22.18 BY MISTAKE IN THE DEED OF TRUST) FEET TO A POINT IN THE NORTHEAST RIGHT OF WAY OF SAID ROAD AND THE POINT OF BEGINNING OF LAND HEREIN DESCRIBED: THENCE NORTH 53 DEGREES 48 MINUTES 37 SECONDS EAST, 503.25 FEET; THENCE SOUTH 20 DEGREES 15 MINUTES 35 SECONDS EAST, 131.48 FEET; THENCE SOUTH 30 DEGREES 18 MINUTES 35 SECONDS WEST, 189.70 FEET; THENCE SOUTH 67 DEGREES 46 MINUTES 45 SECONDS WEST, 237.34 FEET TO THE RIGHT OF WAY OF SAID ROAD; THENCE NORTH 53 DEGREES 31 MINUTES 05 SECONDS WEST, 40.85 FEET TO A POINT IN SAID RIGHT OF WAY; THENCE NORTH 61 DEGREES 47 MINUTES 50 SECONDS WEST, 117.33 FEET TO THE POINT OF BEGINNING; BEING A PART OF THE NW-1/4 OF SE-1/4, SECTION 3, TOWNSHIP 7 NORTH, RANGE 11 EAST, NEWTON COUNTY, MISSISSIPPI, AND CONTAINING 1.7 ACRES, MORE OR LESS.
PROPERTY ADDRESS: The street address of the property is believed to be 1661 SCANLAN ROAD, DECATUR, MS 39327. In the event of any discrepancy between this street address and the legal description of the property, the legal description shall control.
Title to the above described property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee.
