NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 03/30/2004, ROBERT W STRICKLAND AND KATHY M STRICKLAND executed a promissory note payable to the order of AMERIQUEST MORTGAGE COMPANY.
WHEREAS, the aforesaid promissory note was secured by a Deed of Trust dated 03/30/2004, executed by ROBERT W STRICKLAND AND KATHY M STRICKLAND and being Recorded on 04/13/2004 in Book 272, Page 755 and Re Recorded on 04/22/2004 in Book 273, Page 241 of the records of the Newton County, State of Mississippi; and which aforesaid Instrument conveys to JIM B TOHILL, Trustee and to AMERIQUEST MORTGAGE COMPANY, as Beneficiary, the hereinafter described property; and
WHEREAS, AMERIQUEST MORTGAGE COMPANY assigned said Deed of Trust to Deutsche Bank National Trust Company, as Trustee for Ameriquest Mortgage Securities Inc., Asset-Backed Pass-Through Certificates, Series 2004-R5 via an instrument filed of record on September 18, 2007 in Book 312, and at Page 725 in the office of the Clerk of the Newton County, State of Mississippi; and
WHEREAS, DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR AMERIQUEST MORTGAGE SECURITIES INC., ASSET-BACKED PASS-THROUGH CERTIFICATES, SERIES 2004-R5 appointed WESTERN PROGRESSIVE - MISSISSIPPI, INC, as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 01/07/2026 and recorded on 01/14/2026 in Book 506, Page 560 of the records of the Newton County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said promissory note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc, the Substituted Trustee in said Deed of Trust will on 02/25/2026, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the At Main Front Door, Newton County Courthouse, 92 West Broad Street, Decatur, MS 39327, the following described property located and situated in Newton, Mississippi, to wit:
A certain parcel of land located in the Northeast Quarter of the SE Quarter of Section 10, Township 8 North, Range 10 East, Newton County, Mississippi; run thence West for 880.45 feet; thence North for 149.92 feet to an iron pin found on the North right of way of Mississippi State Hwy #492; continue thence North for 837.03 feet (record: 836.80 feet) to an iron pin found; thence South 89 degrees 24 minutes West for 41.60 feet to an iron rod set on the East edge of a gravel drive and the point of beginning: continue thence South 89 degrees 24 minutes W (Record: West) for 398.40 feet to an iron rod set; thence South 01 degrees 27 minutes E (Record: West) for 119.47 feet to an iron rod set; thence North 89 degrees 24 minutes E for 348.08 feet to an iron rod set on the West edge of a gravel drive; thence North 21 degrees 31 minutes E for 128.94 feet to the point of beginning. Containing 1.02 Acres.
And, a 20 foot perpetual easement over and across the following described property for ingress and egress to the above described property:
Commence at an iron pin on the SE corner of the NE 1/4 of the SE 1/4 Section 10, Township 8 North, Range 10 East, Newton County, Mississippi, and run West 1319.00 feet along the South line of said forty to the SW corner of said NE 1/4 of the SE 1/4; thence run North 242.09 feet along West line of said forty to the South right of way of MS. Hwy #492 to and for the point of beginning; thence continue North 746.00 feet along said West forty line; thence run East 440.00 feet; thence run South 836.80 feet to a point on the Northern Right of Way of Ms. Highway #492; thence run Northwesterly along said Hwy. #492 Right of Way With curve to the Right of Delta=08 degrees 31 minutes 37 seconds; Degree Curve = 01 degrees 53 minutes 47 seconds; Radius of 3021.25; Chord Brg. and Dia. is N. 78 degrees 20 minutes 38 seconds; Wet, 449.21 feet running along the Arc of said curve 449.62 feet back to the point of beginning. Containing 8.03 acres, more or less, and being located in the NE 1/4 of the SE 1/4 Section 10, Township 8 North, Range 10 East, Newton County, Mississippi.

Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand, and gravel in or under subject property.
As the undersigned Substituted Trustee, Western Progressive - Mississippi, Inc, will convey only such title as is vested in it under said Deed of Trust.
