AMENDING ARTICLE IV
NOISE CONTROL OF
CHAPTER 30 ENVIRONMENT
WHEREAS, the Mayor and Board of Aldermen of the City of Newton, Mississippi have a central purpose of preserving and protecting the health, safety and welfare of the general public;
WHEREAS, the Mayor and Board of Aldermen of the City of Newton, Mississippi find that excessive, unnecessary and unreasonable sounds within the City are detrimental to the public health, safety and welfare of the general public, welfare and peace and quiet of the inhabitants of the City and are therefore declared a public nuisance;
WHEREAS, the use of fireworks within the city limits is such an excessive, unnecessary and unreasonable sound;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF
ALDERMEN OF THE CITY OF NEWTON AS FOLLOWS:
The Mayor and Board of Aldermen do hereby enact the following Section to Article IV - Noise Control of Chapter 30 Environment of its Code of Ordinances:
Section 30-161 -Fireworks.
The use of fireworks within the city limits is hereby prohibited except on the following dates and times:
1. From May 23rd through July 3rd from 6:00 p.m. until 10:00 p.m.;
2. On July 4th from 6:00 p.m. until 1 :00 a.m. on July 5th
3. From July 5th through July 12th from 6:00 p.m. until 10:00 p.m.
4. From December 5th through December 30th from 6:00 p.m. until 10:00 p.m.;
5. On December 31st from 6:00 p.m. until 2:00 a.m.;
6. On January 1st from 6:00 p.m. until 12:00 a.m.; and
7. From January 2nd through January 9th from 6:00 p.m. until 10:00 p.m.
THIS ORDINANCE GOES INTO EFFECT THIRTY (30) DAYS AFTER ITS PASSAGE.
THE PUBLIC INTEREST REQUIRING THAT IT BE PUBLISHED IN THE NEWTON COUNTY APPEAL AS REQUIRED BY LAW. THIS ORDINANCE ADOPTED IN REGULAR MEETING, THIS THE 7th DAY OF October 2025.
