SUBSTITUTE TRUSTEE’S NOTICE OF SALE
WHEREAS, on April 16, 2007, Ronnie E. Pearson married and Alice Pearson, married executed a deed of trust for the benefit of Walter Mortgage Company, which deed of trust was recorded on May 8, 2007, in Book 308, Page 292 in the office of the Chancery Clerk of Newton County, Mississippi; and Said Deed of Trust was last sold, assigned and transferred to U.S. Bank, N.A., as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee, successor by merger to First Union National Bank as Trustee, for Mid-State Trust VIII by assignment recorded in Book 442, Page 600 in the office of the Chancery Clerk, Newton County, Mississippi.
WHEREAS, the holder of the deed of trust at the time of the substitution substituted McCalla Raymer Leibert Pierce, LLC as Trustee, as authorized by the terms thereof, by instrument recorded on May 7, 2020, and spread at large upon the records in the office of the aforesaid Chancery Clerk in Book 448, Page 294, prior to the posting and publication of this notice; and
WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, U.S. Bank, N.A., as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee, successor by merger to First Union National Bank as Trustee, for Mid-State Trust VIII, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee’s fees and expenses of sale;
THEREFORE, on July 22, 2020, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the front door of the Newton County Courthouse in Decatur, Mississippi, the following described land, property and improvements lying and being situate in Newton County, Mississippi, to-wit:
Commence at the Southwest corner of the Northwest Quarter of Southwest Quarter, Section 25, Township 8 North, Range 12 East, Newton County, Mississippi, thence North 1043.76 feet to a point; thence East 387.28 feet to the point of beginning of the herein described property; thence South 88 degrees 00 minutes East, 325.01 feet to a point in the West right of way line of the Beulah-Hubbard-Hickory Road; thence North 10 degrees 34 minutes West, 175.0 feet along said right of way to a point in the centerline of the Herbon-Hopewell Road; thence North 88 degrees 00 minutes West, 330.04 feet along said centerline to a point; thence South 12 degrees 10 minutes East 176.17 feet to the point of beginning; being a part of the Northwest Quarter of Southwest Quarter, Section 25, Township 8 North, Range 12 East, Newton County, Mississippi, and containing 1.29 acres, more or less.
