NOTICE OF SALE
WHEREAS, on November 19, 2021, Brian Christopher Ford, executed a Deed of Trust to Donald G. Griffin, Trustee for Community Bank of Mississippi, which Deed of Trust was recorded on November 22, 2021, at Book 465, Page 729 in the office of the Chancery Clerk of Newton County, Mississippi;
WHEREAS, the aforesaid Community Bank of Mississippi, the holder of said deed of trust and the note secured thereby, substituted Pine Belt Land Title, LLC, as Trustee therein, as authorized by the terms thereof, by instrument recorded May 9, 2024, at Deed Book 489, Page 224 in the office of the aforesaid Chancery Clerk of Newton County, Mississippi; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said deed of trust, and the legal holder of said indebtedness, Community Bank of Mississippi, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substituted Trustee's fees and expense of sale;
NOW, THEREFORE, Pine Belt Land Title, LLC, Substituted Trustee in said deed of trust, will on June 6, 2024 offer for sale at public outcry for cash to the highest bidder, and sell within legal hours (being between the hours of 11:00 A.M. and 4:00 P.M.) on the front steps of the Newton County Courthouse, located in Decatur, Mississippi, the following described property situated in the County of Newton, State of Mississippi, to-wit:
Start at the Northeast corner of Section 35, T6N, R11E, City of Newton, Newton County, Mississippi, and run thence South 1626.4 feet; thence West, 1358.9 feet; thence S 01 degree 20’ E, 141.0 feet; thence S 57 degrees 30’ E, 23.0 feet; thence S 00 degrees 03’ W, 81.69 feet to the Point of Beginning; thence continue S 00 degrees 03’ W, 502.51 feet; thence S 01 degree 27’ E, 276.0 feet; thence West, 595.0 feet to the East right-of-way line of Mississippi Highway 15; thence N13 degrees 22’ E, 296.0 feet along the said right-of-way line; thence N 10 degrees 17’ E, 575.76 feet along the said right-of-way line; thence S 79 degrees 37’ 15” E, 424.30 feet to the Point of Beginning. The herein described property is situated in the SW ¼ of the SW ¼ of the said Section 35 and contains 9.41 acres, more or less.

Martino, PLS, INC. dated 4/1/2022 (reference meridian for bearings are based on geodetic North by GPS observation (NAD83; CORS96), all lines relative to) and being more particularly described as follows:
Commencing at the Northeast corner of the Northeast ¼ of the Southwest ¼ of said Section 35; thence S00°08’52”E 1626.4 feet; thence S89°51’08”W 1358.9 feet to a ½” iron rod found lying on the West line of the property now or formerly of Morning Star Missionary Baptist Church property, per Deed Book 182 at Page 334; thence along the West line of said Morning Star Baptist Church, S01°34’31”E 140.05 feet to a ½” iron rod found; thence continue along the West lien of said Morning Star Baptist Church property, S61°39’21”E 20.00 feet to a set ½” iron rod with cap stamped Martino PLS 02838; thence continue along the West line of said Morning Star Baptist Church property S00°11’55”E 41.38 feet to a ½” iron rod found lying at the Northwest corner of the property now or formerly of Barnett, per Deed Book 391 at Page 610; thence along the West line of said Barnett property, S00°11’55”E 40.31 feet to a set ½” iron rod with cap stamped Martino PLS 02838 lying at the Northeast corner of the property now or formerly of Ford, per Deed Book 390 at Page 765; thence along the North line of said Ford property, N80°14’04”W 86.88 feet to a set ½” iron rod with cap stamped Martino PLS 0283; thence continue along the North line of said Ford property, N80°14’04”W 279.66 feet to a set ½” iron rod with cap stamped Martino PLS 02838 lying at the Point of Beginning; thence leaving the North line of said Ford property, along a curve to the right, having a radius of 5954.58 feet, an arc length of 150.00 feet, and a chord bearing and distance of S08°40’51”W 150.00 feet to a set ½” iron rod with cap stamped Martino PLS 02838; thence S36°28’04”E 34.76 feet to a set ½” iron rod with cap stamped Martino PLS 02838; thence along a curve to the right, having a radius of 5979.58 feet, an arc length of 120.00 feet, and a chord bearing and distance of S10°12’33”W 120.00 feet to a set ½” iron rod with cap stamped Martino PLS 028388; thence N79°25’36”W 75.00 feet to a SE ½” iron rod with cap stamped Martino PLS 02838 lying on the East margin of Mississippi State Highway 15, per Mississippi Department of Transportation plans being State Project Number SP-0022-2(14); thence along the East margin of Mississippi State Highway 15, along a curve to the left having a radius of 5904.58 feet, an arc length of 293.00 feet, and a chord bearing and distance of N09°21’55”E 292.97 feet to a set ½” iron rod with cap stamped Martino PLS 02838 lying at the Northwest Corner of aforementioned Ford property; thence along the North line of said property, S80°14’04”E 50.03 feet to the Point of Beginning Said parcel contains 0.41 acre, more or less.
