NOTICE OF SALE
WHEREAS, on March 20, 2015, Thomas Scott Sellers and Melissa J. Sellers executed a Deed of Trust to Bobby Knox, Trustee for Community Bank, Ellisville, Mississippi, which Deed of Trust was recorded on March 30, 2015, at Book 394, Page 132 in the office of the Chancery Clerk of Newton County, Mississippi;
WHEREAS, on August 28, 2020, Thomas Scott Sellers and Melissa J. Sellers executed a Modification of Deed of Trust to Community Bank of Mississippi, said Modification was recorded on September 2, 2020, at Book 451, Page 376 in the office of the Chancery Clerk of Newton County, Mississippi, pertaining to the following described property situated in said County and State, to-wit:
WHEREAS, the aforesaid Community Bank of Mississippi, the holder of said deed of trust and the note secured thereby, substituted Paul D. Walley, as Trustee therein, as authorized by the terms thereof, by instrument dated July 13, 2022, and recorded July 26, 2022, at Book 474, Page 155 in the office of the aforesaid Chancery Clerk of Newton County, Mississippi; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said deed of trust, and the legal holder of said indebtedness, Community Bank, Ellisville, Mississippi, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substituted Trustee's fees and expense of sale;
NOW, THEREFORE, I, Paul D. Walley, Substituted Trustee in said deed of trust, will on March 19, 2025 offer for sale at public outcry for cash to the highest bidder, and sell within legal hours (being between the hours of 11:00 A.M. and 4:00 P.M.) on the steps of the Newton County Courthouse located in Decatur, Mississippi, the following described property situated in the County of Newton, State of Mississippi, to-wit:
All that part of the NW ¼ of SW ¼, lying and being South of Archie Road and East of Blue Springs Road, in Section 35, Township 7 North, Range 13 East, Newton County, Mississippi.
