SUBSTITUTED TRUSTEE'S
NOTICE OF SALE
WHEREAS, on February 19, 2020, William E. Dear, Jr. and wife, Sandra Dear executed a certain deed of trust to Adams & Edens, PA, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc., as nominee for Nationstar Mortgage, LLC D/B/A Mr. Cooper which deed of trust is of record in the office of the Chancery Clerk of Newton County, State of Mississippi in Book 446 at Page 420; and
WHEREAS, LLG MS LLC has heretofore been substituted as Trustee by instrument dated January 24, 2023 and recorded in the aforesaid Chancery Clerk's Office in Book 478 at Page 723; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, ALLIED FIRST BANK, SB DBA SERVBANK, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, LLG MS LLC, Substituted Trustee in said deed of trust, will on September 6, 2023 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the North Door of the County Courthouse of Newton County, located at 92 West Broad Street, Decatur, MS 39327, to the highest and best bidder for cash or certified funds the following described property situated in Newton County, State of Mississippi, to-wit:
The land hereinafter referred to is situated in the City of Decatur, County of Newton, State of MS, and is described as follows:
A strip of land 41 feet wide off of and across the South side of Lot No. 25; and Lot No. 26, less and except a strip of land 30 feet wide off of and across the North side thereof; and a strip of land 30 feet in width off of and across the North side of Lot No. 27, all being situated in the Gallaspy Subdivision of the Town of Decatur, Newton County, Mississippi as per plat or map of said subdivision on file in the office of the Chancery Clerk of Newton County, Mississippi; Less and Except a strip of land 20 feet North and South by 245 feet East and West, conveyed to Raymond Comans as described in Deed Book 132, at page 468 of the land records of said county.
And:
A parcel of land lying and being a part of Lot 3 and Lot 4 of Gallaspy Subdivision of the Town of Decatur, Newton County, Mississippi, being more particularly described as follows, to-wit: Commencing at a 1/2 inch iron pin found being the Southwest corner of Lot 3 of Gallaspy Subdivision of the Town of Decatur, Newton County, Mississippi; thence run North 1 degree 15 minutes 00 seconds East along the West line of said Lot 3 for a distance of 51.55 feet to the point of beginning of the herein described parcel of land; thence run North 1 degree 15 minutes 00 seconds East along said West line and continuing along the West line of said Lot 4 for a distance of 116.02 feet to a 1/2 inch iron pin set; thence run South 89 degrees 57 minutes 15 seconds East for a distance of 242.76 feet to a 1/2 inch iron pin found on the Eastern right-of-way fine of 4th Avenue; thence run South I degree 43 minutes 36 seconds West along said right-of-way line for a distance of 18.00 feet to a 1/2 inch iron pin set; thence run North 89 degrees 57 minutes 15 seconds West for a distance of 182.57 feet to a 1/2 inch iron pin set; thence run South 1 degree 15 minutes 00 seconds West for a distance of 100.00 feet to a 1/2 inch iron pin set; thence run North 89 degrees 57 minutes 15 seconds West for a distance of 60.04 feet to the point of beginning.
Being the same property conveyed from Mike A. Anderson and wife, Nan D. Anderson to William E. Dear, Jr. and wife, Sandra Dear, as tenants by the entirety with full rights of survivorship and not as tenants in common by deed dated October 20, 2018 and recorded December 20, 2018 in Book 375 and Page 129, of official records.
I WILL CONVEY only such title as vested in me as Substituted Trustee.
