SUBSTITUTED TRUSTEE'S
NOTICE OF SALE
WHEREAS, on May 26, 2017, Dennis G. Harvey and Jasmonique Lashay Lewis, executed a Deed of Trust to Hez Hollingsworth, Trustee for the benefit of Bank of Morton, which Deed of Trust is recorded in Deed of Trust Book 418 at Page 514, in the office of the Chancery Clerk of Newton County, Mississippi; and
WHEREAS, on October 21, 2022, Jasmonique Lewis, executed a Deed of Trust to Hez Hollingsworth, Trustee for the benefit of Bank of Morton, which Deed of Trust is recorded in Deed of Trust Book 476 at Page 621, in the office of the Chancery Clerk of Newton County, Mississippi; and
WHEREAS, Bank of Morton, the owner and holder of said notes and deeds of trust securing the same, substituted J. Tyler McCaughn as Trustee therein in the place and stead of Hez Hollingsworth as authorized by the terms thereof by instrument dated August 9, 2023, and recorded in Deed of Trust Book 483, Page 251, in the office of the Newton County Chancery Clerk; and
WHEREAS, default having been made in the terms and conditions of said Deeds of Trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms in said Deeds of Trust and the legal holder of said indebtedness, Bank of Morton, having requested the undersigned, as Substituted Trustee, to execute the trust and sell said land and property in accordance with the terms of said Deeds of Trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substituted Trustee's fees and expenses of sale.
NOW, THEREFORE, I, J. Tyler McCaughn, Substituted Trustee in said Deeds of Trust, will, on the 15th day of September, 2023, offer for sale and will sell at public outcry to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the North front door of the Newton County Courthouse on Broad Street in Decatur, Mississippi, the following described property lying and being situated in the County of Newton, State of Mississippi, to-wit:
All that certain tract or parcel of land lying and being located in Newton County, State of Mississippi being more particularly described as follows:
Start at the NE corner of Lot 1 Block 16 of Harrod’s Plat, Town of Newton, Newton County, Mississippi and run 75 degrees 30 minutes East along the South side of First Street for a distance of 460 feet to the NW corner of Lot 12 Block 8 of Harrod’s Plat which is the point of beginning. Thence run South 75 degrees 30 minutes East along the South side of First Street for a distance of 150 feet; thence South 14 degrees 30 minutes West along the East line of Lots 12, 11 and ½ of 10, Block 8 for a distance of 125 feet; thence North 75 degrees 30 minutes West for a distance of 150 feet; thence 14 degrees 30 minutes East along the East side of Decatur Street for a distance of 125 feet to the point of beginning. The above described property being all of Lots 11 and 12 and the North ½ of Lot 10 Block 8, Harrod’s Plat, and being (+) 0.43 acres more or less. Property situated in Section 34, Township 6 North, Range 11 East, Town of Newton, Newton County, Mississippi. Being the same property conveyed to Georgia A. Hunter and husband Edward Hunter in a Warranty Deed filed for record on 3-08-99 in Book 267 at Page 707; then conveyed to Georgia Hunter in a Quitclaim Deed filed for record 6-16-04 in Book 298 at Page 174.
Title to said property is believed to be good but I will only convey such title as is vested in me as Substituted Trustee.
