SUBSTITUTED TRUSTEE'S
NOTICE OF SALE
WHEREAS, on the 8th day of February 2023, Quincy A. Green and Theresa M. Green executed a certain Deed of Trust to Thomas R. Hudson, Trustee, for the benefit of BankPlus, a Mississippi Banking Corporation, which Deed of Trust was recorded in the office of the Chancery Clerk of Newton County, Mississippi, and recorded in Deed of Trust Book 481 at Page 87 of the land records; and,
WHEREAS, Simpson Law Firm PA has been substituted in the place and stead of Thomas R. Hudson, Trustee for BankPlus, a Mississippi Banking Corporation, said Appointment of Substitute Trustee being recorded in Book 487 at Page 471 of the records of the Chancery Clerk of said County; and,
WHEREAS, fee simple title is vested in Quincy A. Green and Theresa M. Green; and,
WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, the legal holder of said indebtedness, BankPlus, a Mississippi Banking Corporation, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, Simpson Law Firm PA, Substituted Trustee in said Deed of Trust, will on the 4th day of April, 2024, offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the Front Door of the Newton County Courthouse, in Decatur, Mississippi, to the highest and best bidder for cash the following described property situated in Newton County, State of Mississippi, to-wit: Start at the Southeast corner of the Northeast quarter of the Northwest quarter (NE 1/4 of NW 1/4) Section 35, Township 6 North, Range 11 East, City of Newton, Newton County, Mississippi, and run thence North, 318.0 feet; thence West 889.6 feet to the point of beginning: Thence South 04 degrees 00 minutes West, 100.0 feet; thence North 72 degrees 23 minutes West, 107.3 feet to East line of Pilate Avenue; thence North 01 degree 15 minutes East, 100.0 feet along the East line of Pilate Avenue to the South line of a dirt road; thence South 73 degrees 00 minutes East, 112.0 feet along the South line of said dirt road to the point of beginning. The herein described property is situated in the Northeast quarter of the Northwest quarter (NE 1/4 of NW 1/4) of the said Section 35 and contains 0.25 acre, more or less.
