SUBSTITUTE TRUSTEE'S
NOTICE OF SALE
WHEREAS, on July 2, 2018, Rocky Campbell and Linda Campbell, husband and wife, executed a Deed of Trust to Timothy L. Gowan, Trustee for the benefit of Mortgage Electronic Registration Systems Inc., (MERS), as recorded in the office of the Chancery Clerk of Newton County, Mississippi, in Book 429 at Page 681; and,
WHEREAS, Mortgage Electronic Registration Systems Inc., (MERS), assigned said Deed of Trust to Trustmark National Bank by instrument dated May 6, 2025, recorded in Book 499 at Page 643 of the records of the office of the Chancery Clerk aforesaid; and,
WHEREAS, Trustmark National Bank, the holder of said Deed of Trust and the Note secured thereby, substituted McKay Franklin PLLC as Trustee therein, as authorized by the terms thereof, by instrument dated May 22, 2025, and recorded in Book 500 at Page 228 in the office of the Chancery Clerk aforesaid; and,
WHEREAS, on or about August 1, 2025, Trustmark National Bank, a national banking association, converted to Trustmark Bank, a Mississippi banking corporation ("Trustmark Bank"), retaining all rights, claims, and interests in and to the aforementioned Deed of Trust and the indebtedness secured thereby; and
WHEREAS, default having been made in the terms and conditions of said Deed of Trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness having requested the undersigned Substitute Trustee to execute the Trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney’s fees, Substitute Trustee's fees and expenses of sale;
NOW, THEREFORE, the undersigned McKay Franklin PLLC, being the Substitute Trustee, does hereby give notice that on January 28, 2026, between 11:00 o'clock a.m. and 4:00 o'clock p.m., being the legal hours of sale, it will proceed to sell at public outcry, to the highest bidder for cash, at the front door of the Newton County Courthouse in Decatur, State of Mississippi, the following real property described and conveyed in said Deed of Trust, lying and being situated in Newton County, Mississippi, and being more particularly described as follows, to-wit:
The following description is based on the Mississippi State Plane Coordinate System, East Zone, NAD 83(2011), Grid Values, (U.S. Survey Feet), using a combined factor of 0.999939493 a convergence angle of minus (-) 00 degrees 09 minutes 22.54 seconds calculated at the commencing point of the following description.
Commencing at a found 1 1/2" iron pipe marking the Southeast corner of the SW 1/4 of Section 12, Township 5 North, Range 11 East, Newton County, Mississippi, being further defined as N: 1012095.299 feet, E: 893830.772 feet on the above referenced coordinate system; thence run North 63 degrees 58 minutes 43 seconds West a distance of 1173.97 feet to a point being a 1/2" rebar and cap set on the Westerly observe right of way line of Shelby Road, having the grid coordinates of N: 1012610.337 feet, E: 892775.811 feet and the POINT OF BEGINNING of the herein described parcel of land; thence North 47 degrees 59 minutes 16 seconds West a distance of 24.04 feet to a point being a set 1/2" rebar and cap; thence North 83 degrees 40 minutes 42 seconds West a distance of 177.59 feet to a point being a set 1/2" rebar and cap; thence South 84 degrees 38 minutes 19 seconds West a distance of 32.68 feet to a point being a set 1/2" rebar and cap; thence South 74 degrees 48 minutes 14 seconds West a distance of 150.50 feet to a point being a set 1/2" rebar and cap; thence North 89 degrees 57 minutes 08 seconds West a distance of 193.02 feet to a point being a set 1/2" rebar and cap; thence South 67 degrees 51 minutes 08 seconds West a distance of 147.90 feet to a point being a set 1/2" rebar and cap; thence South 59 degrees 55 minutes 59 seconds West a distance of 261.51 feet to a point being a set 1/2" rebar and cap; thence South 70 degrees 47 minutes 04 seconds West a distance of 554.88 feet to a point being a set 1/2" rebar and cap; thence North 15 degrees 13 minutes 26 seconds West a distance of 194.52 feet to a point being a set 1/2" rebar and cap; thence North 69 degrees 03 minutes 01 seconds East a distance of 288.74 feet to a point being a set 1/2" rebar and cap; thence North 09 degrees 49 minutes 12 seconds West a distance of 85.37 feet to a point being a set 1/2" rebar and cap; thence North 66 degrees 27 minutes 21 seconds East a distance of 200.48 feet to a point being a set 1/2" rebar and cap; thence South 84 degrees 18 minutes 33 seconds East a distance of 231.44 feet to a point being a set 1/2" rebar and cap; thence North 82 degrees 06 minutes 15 seconds East a distance of 409.67 feet to a point being a set 1/2" rebar and cap; thence South 81 degrees 04 minutes 47 seconds East a distance of 144.50 feet to a point being a set 1/2" rebar and cap; thence South 60 degrees 21 minutes 49 seconds East a distance of 60.14 feet to a point being a set 1/2" rebar and cap; thence South 82 degrees 35 minutes 57 seconds East a distance 219.65 feet to a point being a set 1/2" rebar and cap; thence North 71 degrees 54 minutes 59 seconds East a distance of 26.39 feet to a point being a 1/2" rebar and cap said on westerly observed right of way line; thence coincident with said westerly right of line on a curve turning to the right an arc length of 41.20 feet, having a radius of 1608.56 feet, the chord of said curve bears South 13 degrees 09 minutes 48 seconds West, a distance of 41.20 feet back to the point of beginning. The herein described parcel of land contains 5.53 acres, more or less, being situated in and a part of the S 1/2 of the SW 1/4, Section 12, Township 5 North, Range 11 East, Newton County, Mississippi.
The undersigned will convey only such title as is vested in it as Substitute Trustee.
